Will of Sir Thomas Lovell K.G: Part 3
Item: I will that Thomas Manners now Lord Ross shall have my manor place that I dwell in at Enfield called Elsynges, within the county of Middlesex, and all my manors, lands and tenements, rents, reversions and services and other hereditaments with the appurtenances which I have or any other to my use have within the town and parish of Enfield within the county of Middlesex, to him and his heirs males of his body lawfully begotten, paying yearly, to such persons as shall be named by me in this my last will, ten pounds and during their lives natural in manner and form as I shall declare and express in this my last will: That is to say to my servants Lawrence Foxley ten marks and Robert Leche five marks, without any contradiction or let in payment of the same.
And if it happen the same Thomas Manners Lord Ross to die without heirs males of his body lawfully begotten, then I will that the foresaid manor place and all the foresaid manors, lands tenement, rents, reversions and services and other the premisses with their appurtenances within the foresaid town and parish of Enfield within the county of Middlesex shall remain unto Oliver Manners, brother to the said Lord Ross and to his heirs males of his body lawfully begotten; the same Oliver and his heirs males of his body lawfully begotten paying yearly to the said Lawrence Foxley and Robert Leche ten pounds in manner and form as before is declared during their lives natural.
And if it fortune the said Oliver Manners to die without heirs males of his body lawfully begotten, then I will that the said manor place and all the foresaid manors, lands, tenements, rents, reversions and services, and other the premisses with their appurtenances within the foresaid town and parish of Enfield within the county of Middlesex foresaid shall remain to Richard Manners, brother to the said Oliver Manners, and to his heirs males of his body lawfully begotten; the same Richard Manners and his heirs males of his body lawfully begotten paying yearly to the said Lawrence Foxley and Robert Leche ten pounds in manner and form as is before declared during their natural lives.
And if it happen the said Richard Manners to die without heirs males of his body lawfully begotten, then I will the foresaid manor place and all the foresaid manors, lands and tenements, rents and reversions and services and other the premisses with their appurtenances within the foresaid town and parish within the said county of Middlesex shall remain to the right heirs of the said Thomas Manners Lord Rosse forever, they paying the said ten pounds yearly to the said Lawrence Foxley and Robert Leche in manner and form as before is rehearsed and specified, if they be living and not dead.
And where I have heretofore willed and bequeathed my manor place called Elsynges in Enfield in the county of Middlesex unto Thomas Manners now Lord Ross and to his heirs males of his body lawfully begotten, and for default of such issue then to Oliver Manners and his heirs males of his body lawfully begotten, and for default of such issue then to Richard Manners and his heirs males of his body lawfully begotten, and for default of such issue the remainder thereof to the right heirs males of the said Thomas Manners Lord Ross forever, yet nevertheless that my gift and bequest, I will that my executors shall have the use and occupation of my said manor place called Elsynges in Enfield with the gardens, orchards and grounds adjoining to the said manor by the space of two whole years full complete next and immediately ensuing after my decease, without any interruption, let or impediment to the contrary to be made, moved or stirred by the said Thomas Manners or his heirs males or of the right heirs males of the said Thomas Manners Lord Ross to the perturbance or breaking of this my testament and last will.
Also I will the said Thomas Manners now Lord Ross shall have all those my lands and tenements, rents, farms and fee-farms, reversions, services and other hereditaments which I have or any other person or persons to my use have within the city, town and fields of Chichester within the county of Sussex; and also all my lands and tenements, rents, farms and fee-farms, reversions, services and other hereditaments which I have or any other person or persons to my use have within the towns and fields of Andover and Basingstoke, Netherwallop Buckland Overwallop Buckland and Broughton, with their appurtenances in the county of Wiltshire and Southampton, Leigham within the county of Suffolk, to have and to hold to the said Thomas now Lord Ross and to the heirs males of his body lawfully begotten.
And if it happen the said Thomas Manners Lord Ross to die without any heirs males of his body lawfully begotten, then I will that all my foresaid lands and tenements, farms, fee-farms, rents, reversions and services and all other hereditaments with their appurtenances within the said city of Chichester in the county of Sussex, in the towns of Andover and Basingstoke, in the towns and fields of Netherwallop, Buckland Overwallop, Buckland and Broughton in the counties of Wiltshire and Southampton and in the town and fields of Leigham in the county of Suffolk shall remain to Oliver Manners, brother to the said Thomas Manners Lord Ross and to the heirs males of his body lawfully begotten.
And if it happen Oliver Manners to die without any heirs males of his body lawfully begotten, then I will that all the foresaid lands and tenements, rents, farms and fee-farms, reversions and services and all other hereditaments with their appurtenances within the said city, towns and fields of Chichester, Andover Basingstoke, Netherwallop, Buckland Overwallop, Buckland Broughton and Leigham in the county of Sussex, South Wiltshire and Suffolk, shall remain to Richard Manners, brother to the said Thomas Manners Lord Ross, and to his heirs males of his body lawfully begotten.
And if it happen the said Richard Manners to die without any heirs males of his body lawfully begotten, then I will that all the foresaid lands and rents, farms, fee-farms, reversions and services with their appurtenances within the said city towns and fields of Chichester in the county of Sussex, Andover and Basingstoke, Netherwallop, Buckland Overwallop, Buckland and Broughton in the counties of Wiltshire and Southampton and Leigham in the county of Suffolk, shall remain to the right heirs of the said Thomas Manners Lord Ross forever.
Also I will that Oliver Manners and Richard Manners, brethren to the said Thomas Manners Lord Ross shall have my lands and tenements, rents, farms and fee-farms with their appurtenances and reversions, services and hereditaments which I have or any other person or persons to my use have within the towns and fields of Colyngham and Berdsey in the county of York and in the town and fields of Cogshales in Fordham in the county of Cambridge, which together be of the yearly value of twenty pounds clear, which I will it be divided to either of the said Oliver and Richard; ten pounds yearly during their lives natural.
And after the decease of one of them, then I will that the whole sum of twenty pounds of the yearly revenues of the said lands in Colyngham, Bardsey and Fordham in the counties of York and Cambridge shall remain to the survivor and longest liver of the said Oliver and Richard Manners during his life natural.
And after his death I will that all my said lands and tenements, farms, fee-farms, rents, reversions and services and other hereditaments with their appurtenances within the said towns and fields of Colyngham and Berdsey in the County of York and Cogshales in Fordham in the county of Cambridge shall remain to Thomas Manners Lord Ross and to his heirs males of his body lawfully begotten.
And if it happen the said Thomas Manners Lord Ross to die without heirs males of his body lawfully begotten, then I will that the foresaid lands and tenements, rents, farms, reversions and services with their appurtenances and other hereditaments in Colyngham and Bardsey in the county of York and Cogshales in Fordham in the county of Cambridge shall remain wholly to the right heirs of the said Thomas Manners Lord Ross forever.
